1. Acceptance of Terms

By accessing and using the Moddy Creations website and services, you agree to be bound by these Terms of Service. If you do not agree with any part of these terms, please do not use our services.

2. Services

Moddy Creations provides web design, custom development, e-commerce solutions, and digital marketing services. The scope, timeline, and deliverables for each project will be agreed upon in writing before work begins.

3. Pricing & Payment

• All prices listed on our website are in Kenyan Shillings (KSh) unless otherwise stated.
• A deposit of 50% is required before work begins on any project.
• The remaining balance is due upon project completion and before final delivery.
• Payment can be made via M-Pesa, bank transfer, or other agreed methods.

4. Project Timeline

Estimated delivery times are provided for each service package. Actual timelines may vary depending on project complexity, client responsiveness, and scope changes. Delays caused by late content delivery or feedback from the client may extend the timeline.

5. Revisions

Each package includes a specified number of revision rounds as listed on our pricing page. Additional revisions beyond the included rounds may incur extra charges, which will be communicated and agreed upon before proceeding.

6. Intellectual Property

Upon full payment, the client receives ownership of the final deliverables including design files and source code. Moddy Creations retains the right to showcase the work in our portfolio unless otherwise agreed in writing.

7. Client Responsibilities

• Provide all necessary content (text, images, logos) in a timely manner.
• Provide clear and constructive feedback during the revision process.
• Ensure any provided content does not infringe on third-party rights.

8. Limitation of Liability

Moddy Creations shall not be liable for any indirect, incidental, or consequential damages arising from the use of our services or website. Our total liability shall not exceed the amount paid by the client for the specific service in question.

9. Cancellation & Refunds

If a project is cancelled before work begins, the deposit will be refunded in full. Once work has commenced, refunds will be prorated based on the work completed. No refunds will be issued after final delivery and client approval.

10. Changes to These Terms

We reserve the right to update these terms at any time. Changes will be posted on this page with an updated revision date. Continued use of our services after changes constitutes acceptance.
